The Australian Consumer Law (ACL) mandates that employers must not advertise misleading information about a position or describe a position that does not exist.
Misleading information includes the availability of the work, nature of the work, terms under which the applicant is to work, and conditions of the employment.
If an advertisment is misleading, this can lead to damages claims and violate the ACL.
Examples misleading information include misleading job applicants about a wage deemed a salary but earned through targets or commission basis, or not informing job applicants that cold calling will be required to earn the wage and commission advertised.
Pre-Negotiation
Misleading job applicants also extends to pre-contractual negotiations, including unconscionable conduct by employers.
Unconscionable conduct can include making promises in the pre-negotiation stages of an interview and not keeping to what was promised or stated.
