Driving Under The Influence Of Drugs (DUI) - Traffic Offence
Driving under the influence of an illicit substances charges in NSW range in penalties escalating based on the type and quantity of drugs in your system at the time of driving.
Section 111 of the Road Transport Act 2013 states the offence as:
“A person must not, while there is present in the person’s oral fluid, blood or urine any prescribed illicit drug:
drive a motor vehicle or occupy the driving seat of a motor vehicle and attempt to put the motor vehicle in motion, or if the person is the holder of an applicable driver licence (other than an applicable provisional licence or applicable learner licence) occupy the seat in a motor vehicle next to a learner driver who is driving the vehicle.”
Penalties at Court include for a first offender $2,200 fine or second and subsequent offender $3,300 fine Plus an automatic period of disqualification for a first-time offender is 6 months. It can be reduced but not below a minimum of period of 3 months.
